The same-sex marriage postal survey is being tested in the High Court again today.

Two groups are challenging whether it's legal for the Commonwealth to access funding for the survey, without seeking parliamentary approval.The court has also heard the Bureau of Statistics and the Electoral Commission may not have the legal scope to conduct it. Anne Twomey is a constitutional expert at the University of Sydney.She says some of the arguments put by the opponents yesterday were weak.
