1 News breached crash victims' privacy

People injured in a bus crash in Gisborne on Christmas Eve last year had their privacy breached by 1 News, the Broadcasting Standards Authority has found.

The complaint laid against 1 News for an item which featured photos from Facebook of those injured in the crash was upheld, despite the photos being available in the public domain.

The BSA found the passengers "had a reasonable expectation of privacy over their images... They were in a particularly vulnerable position and did not consent to their images featuring in the news item".

The Tongan community may have seen the use of the photos as a sign of support or respect for those involved in the accident, 1 News argued.

However, broadcasting the pictures "widened the potential audience beyond the community for whom the photos were initially shared on Facebook," the BSA says.

"The publication of content on one platform does not automatically justify further republication on another platform, to a national audience."
