Alabama Judge Rules State's Death Penalty Scheme Unconstitutional

An Alabama circuit judge has ruled the state's death penalty scheme unconstitutional. 

Jefferson County Circuit Judge Tracie Todd barred the death penalty for four men in a capital murder case on Thursday, reports. 

Alabama's death sentencing scheme allows judges to override a jury's recommendation of life in prison and impose capital punishment instead. 

Florida and Alabama are among the states that have such a policy. In January, the Supreme Court ruled Florida's stance unconstitutional.
