Drink driver going 200km/h denied appeal

A man charged with driving drunk, at an excess of 200km/h, has had his appeal against conviction thrown out of court.

Daneel Ovtcharenko applied for discharge without conviction, but was denied by Judge Anne Hinton, despite entering guilty pleas to one charge of driving with an excess breath alcohol and one of driving with an unnecessary exhibition of speed.

Ovtcharenko claimed he did not know he was being chased by a police officer, and therefore was not fleeing for the five kilometres in which he was accused.

However, the judge concluded it was irresponsible and dangerous to drive the way he did, regardless if he was being chased by a police officer.

He plans to appeal for a second time.

He was driving with almost one-and-a-half times the limit of 400mcg, at 525 mcg of alcohol per litre of breath.
