Garage builder gets $30,000 court fine

An Auckland property owner has been fined $30,000 for a resource consent offence a judge described as "the worst of its kind".

Da Jiang Fan was convicted and fined in Auckland District Court after being found guilty in March of deliberately contravening a 2012 abatement notice for building a garage at the front of his Onehunga property.

The court ordered Fan to remove the garage from its current position and either move it back to its original location or demolish it.

Ninety per cent of Fan's fine will be paid to Auckland Council.

Spokesman Ian Smallburn said property owners needed to check the relevant rules before undertaking building work on their properties.

"The ongoing effects of people building without resource consent can be significant, and can adversely affect storm water and other environmental outcomes," he said.
