Real estate agent's loss of licence upheld

A real estate agent who popped a poo in the post to a former employer has lost his bid to continue working until his appeal against the decision to cancel his licence is heard.

The decision comes after agent Grant Tucker fell out with his employer in 2011, Custom Residential, and a director of the company John Wills over the payment of commission to him.

He was later found guilty of disgraceful conduct for sending offensive emails and letters to Mr Wills and his lawyer in 2014, including a package containing faeces and broken glass.

He was also found guilty of a second charge for posting another package in 2015 containing soiled sanitary pads and a condom.

Subsequently on January 26, 2017, the Real Estate Agents Disciplinary Tribunal cancelled Mr Tucker's licence to work as an agent.

Mr Tucker has appealed the tribunal's decision and the findings of misconduct from 2015 and sought to have the High Court at Auckland overturn the ban on his working until the appeals are heard on April 4.

However on Wednesday, Justice Paul Heath upheld the work ban.

He said the interests of protecting the public outweighed Mr Tucker's concerns at being unable to work in his profession.
