Second police complaint over Pert's death

A second complaint has been laid about how police dealt with Auckland jogger Jo Pert's killer the night before her death.

After Mt Roskill man Tevita Mafi Filo, 25, was found not guilty by way of insanity this month, it was revealed officers had pulled him over just hours before Ms Pert's death, carrying a knife and stalking a couple - but that they had let him off with a roadside warning.

The Independent Police Conduct Authority on Wednesday confirmed a second complaint had been laid this week against police over the matter, following one by a family member last week.

"We've only just received [the complaint], so will be evaluating it and will responding to the complainant in due course," IPCA general manager Warren Young said.

The new complaint has been made by a former policeman and friend of Ms Pert's, according to various media reports.

"It's not a witch hunt, I just want to make sure this doesn't happen again," he told the NZ Herald.

Earlier this month Detective Inspector Kevin Hooper told reporters officers searched Filo's car and confiscated a knife the night before Ms Pert's death, but let him go because there were no alerts on the police system.

"I am satisfied from what I know of the situation their decision was right," he said, adding Filo had told officers he had the knife for his own protection.

Filo fatally stabbed Ms Pert - a stranger to him - in the neck early the next morning while she was out exercising, with a Remuera family finding her on their Shore Road lawn.

Filo was found to have been insane at the time of the killing - and during two other incident assaults that followed - after a court heard he believed he was living in a computer program in which he had to do "missions" to get back to the real world.

Police have referred Ms Pert's death to the coroner.
