ACCC will not appeal Woolworths' win

The consumer watchdog will not appeal Woolworths' win in an unconscionable conduct case brought against the supermarket over a scheme that required top-up payments from suppliers.

The Federal Court cleared Woolworths of acting unlawfully in its "Mind the Gap" scheme, after the Australian Competition and Consumer Commission took the matter to court alleging the additional payments requirement breached consumer law.

ACCC chairman Rod Sims said the commission would not be deterred from pursuing future claims of unconscionable conduct where appropriate.
