Water police are investigating possible breaches of the Marine Safety Act following the rescue of five people from a boat off Cairns.

The boat was reported missing around Batt Reef about 8.30pm on Tuesday after those on board failed to make contact for three hours.

They were unable to be contacted and it was not known whether they had adequate supplies on board, so the government rescue helicopter was sent out to search for the six-metre aluminium vessel.

The boat was found and towed back to shore by the coast guard.

The three men, teenager and child on board were uninjured and investigations revealed the vessel had run out of fuel.

Cairns Water Police are investigating whether the Marine Safety Act was breached and have urged boaties to be mindful of their responsibilities.
