Brother of 'stupid' NSW crim avoids jail

A would-be armed robber has been spared jail in a case where his brother posed for an incriminating photo described as ranking high "in the acts of criminal stupidity".

Mandouh Chahal was sentenced over a Kings Cross robbery plot foiled by police months after more than $100,000 was taken from the same pub by a group of men, including his older brother Ammar Chahal.

Ammar Chahal was depicted in a photo on a couch surrounded by quantities of money which included bags of gold-coloured coins from the Vegas hotel's poker machines, said Judge Greg Woods in Sydney's District Court.

"The taking of that photograph ranks high in the acts of criminal stupidity that come before these courts from time-to-time and a couple of months later he was found with that photograph still on his telephone," he said.

The judge has previously jailed Ammar Chahal, 31, and brothers Islam Elshaimy, 24, and Adam Mohamad Elshaimy, 27, over the July 2013 Vegas robbery which was an inside job.

On Monday, he sentenced Mamdouh Chahal, 30, to two years to be served by way of a strict Intensive Corrections Order.

He was not involved in the July robbery, but pleaded guilty to possessing an offensive weapon, a knife, with the intention of committing an armed robbery in company in October 2013.

Police had swooped on the would-be robbers in a laneway behind the pub in a car, where they found items including a horror mask, two tomahawks, and gloves.

The judge found Mandouh Chahal had been subservient to his older brother and intercepted phone calls showed he was "simply going along with it".
