Car a weapon in Tas neighbour dispute

A Tasmanian man hit a quarrelsome neighbour with his car after the victim smashed his windscreen with a brick in a case classified as self-defence by a Supreme Court judge.

In a decision published on Friday, Ricki Graeme Davis, 54, received a three-month jail sentence, suspended for a year on the condition he be of good behaviour, after he pleaded guilty to an assault that caused minor injury.

"The fact that he was holding a brick ... was a threat which justified the use of reasonable force in self-defence. You acted spontaneously and, although you exercised poor judgment, and thereby used excessive force, you did so in difficult and frenetic circumstances," Justice Michael Brett said.
