Dad denied bail bid to attend birth

A man accused of robbing cannabis grow houses will be behind bars when his wife gives birth after a magistrate found he posed too much of a risk to the public to be released.

Police opposed Tyson Folino's application for bail that he made so he could be present for the December 5 induced birth of his second child, describing him as "dangerous" and "out of control".

The expectant father has been in custody since his arrest in relation to an alleged aggravated burglary in July.

Senior Constable Madeline Gillard told the court he is alleged to have threatened civilians and police with a gun during the incident.

Folino is also alleged to have been involved in an aggravated burglary with two co-offenders at a cannabis grow house on February 2 of this year.

Corrections Victoria has agreed to facilitate the expectant father being present for the birth in shackles, with two guards, but Magistrate Cathy Lamble said this is unworkable and it is likely her decision to deny bail would mean he would be unable to attend.

Folino's heavily pregnant wife was present in court to support her husband's application.

She told the court her first birth had been difficult and she needed him by her side to quell her fear and anxiety.

The birth could not take place in the birthing suite if he were to attend in the custody of Corrections Victoria.

Mrs Folino's baby would be born on another level of the hospital where prisoners are taken when they need to receive medical treatment, under the plan proposed by Corrections.

Mrs Folino said her doctor had told her this would not be ideal.

Magistrate Lamble described Folino as a "serious risk" to members of the public.

"Mr Folino has demonstrated a disregard for the well-being of his wife during the period of her pregnancy," she said.

"The community would be flabbergasted if Mr Folino was released."
