A Melbourne man has lost his bid to be bailed for 36 hours to attend the birth of his second child, but Tyson Folino will still be by his wife's side albeit shackled and flanked by prison officers.

The 28-year-old appeared at the Melbourne Magistrates' Court on Thursday seeking bail to attend the birth, with the baby scheduled to be induced on December 5.

Magistrate Cathy Lamble said she didn't have the jurisdiction to grant such a request but noted prison authorities were prepared to make arrangements for Folino to attend the event under guard.
