Manslaughter trial over Qld child's death

A mother and stepfather will stand trial for the alleged manslaughter of a four-year-old Gold Coast boy, who died seven years ago from serious injuries.

Heidi Strbak and her ex-partner Matthew Scown, both aged 33, were originally charged with Tyrell Cobb's murder but on Friday were ordered to stand trial on the lesser charge of manslaughter.

Scown, who is alleged to have punched or kicked Tyrell in the stomach before his death, also applied for bail in the Brisbane Magistrates Court, but will only learn on Monday if he will be released from custody.

The prosecution opposed Scown's bail on the grounds he was an unacceptable risk of not appearing at future court dates.

A committal hearing for the pair this week heard Tyrell was found unconscious at a Biggera Waters home in May 2009 with 70 injuries on his body.

He later died in hospital from internal bleeding and peritonitis - inflammation caused by an infection of the ruptured organ.

Paediatric expert Professor Roy Kimble said Tyrell could have been saved if he had been taken to hospital even hours before his death.

"He certainly had a lot of bruises around his body, much more than would be expected in normal childhood play," Prof Kimble said.

"Obviously this child has had more than one blow to the abdomen, this child has had many blows to cause all the bruises on the body."

Uncle Danial Allan told the court Tyrell was "just not well" and "covered in bruises" on his head and arms the day before he died.

The following day he was "sluggish" and "throwing up green slime", he added.

Tyrell allegedly said Scown had punched him in the stomach and showed Mr Allan a bruise above his genitals.

On a separate occasion, Tyrell allegedly showed his grandmother Diane Strbak a bruise he got after Scown kicked him because he weed on the carpet, the court heard.
