Serial rapist granted release from WA jail

A dangerous sex offender whose crimes included threatening to kill and raping a teenage girl has been granted freedom despite a Perth judge deeming him a serious risk to the community.

Nigel Yates, 39, has a lengthy criminal record including threatening a 15-year-old girl he raped in the back seat of a car, and bashing and raping a 39-year-old woman in a carpark next to a fast-food outlet.

He also attacked a 19-year-old woman on a couch just one day after he was released from prison in 2003.

Yates, who was born in Warburton and raised in an Aboriginal community, was declared a dangerous sex offender in 2014 and his case is reviewed every year.

Chief Justice Wayne Martin said in his judgment handed down on Monday that Yates had made significant progress since last year's review, to the point that the community could be adequately protected by his release under supervision.

"Although the risk that Mr Yates might reoffend can never be entirely eliminated, the conditions to which he will be subject while under supervision should result in any circumstance which might significantly increase the risk of Mr Yates' reoffending coming to the attention of the authorities who can then take appropriate action including, if necessary, bringing Mr Yates back before the court," he said.

Yates will be released on a five-year supervision order and be subject to 54 strict conditions, including living at his prospective partner's home, a curfew, electronic monitoring, no contact with his victims, reporting regularly to police and continuing counselling.
