Vic man knew about underage sex: court

A Victorian man knew he'd had sex with a 13-year-old and asked her not to tell anyone, a court has heard.

Jayden Francavilla, 21, appeared before the Victorian County Court on Thursday after earlier pleading guilty to six sex offences with girls under 16.

Francavilla, who was 18 at the time of offending in 2013 against two victims aged 13 and 15, had been ordered to stand trial but pleaded guilty in May.

He has admitted to committing indecent acts in the presence of a child under 16 and the sexual penetration of a child under 16.

The then teenager, who was friends with both girls in June 2013, went to meet them at a barn, according to the prosecution summary.

The girls had been drinking after their parents had fallen asleep.

When Francavilla arrived he began having sex with both of them.

The sex continued after the 13-year-old girl told him how old she was, the Crown says.

Afterwards, Francavilla told both girls not to tell anyone what happened.

Some time passed before the younger girl informed a teacher at school and police began investigating.

Francavilla was charged over the sex acts when he was 20, about nine months after he was interviewed.

Defence counsel on Thursday submitted the 21-year-old should serve a community corrections order instead of jail time.

He will return to court on September 20 for a further plea hearing and be sentenced at a later date.
