An attempt to re-open an investigation into the fatal police shooting of a bank robber in the 1980s will return to court.

Graeme Jensen was shot in his car in Melbourne by the armed robbery squad in October 1988.

Assistant Commissioner Robert Hill - then a sergeant - was charged with his murder but later acquitted at trial.

In December last year, Jensen's sister filed an application with the Coroner's Court asking it to consider new evidence from a former detective and a surveillance officer that her brother was unarmed and that a gun was planted near his body.

The matter is listed for a directions hearing on Tuesday.
