Wagners press ahead with Qld flood lawsuit

One of Queensland's wealthiest families says it intends to press ahead in a bid to sue the Nine Network over a story about the 2011 Grantham floods despite further setbacks.

Toowoomba entrepreneur Denis Wagner, along with three of his brothers, brought the action against the network, among other broadcasters, following a 60 Minutes program they allege included defamatory material about a quarry owned by the family.

But Justice David Boddice largely upheld an application by Nine in the Brisbane Supreme Court on Thursday, ordering parts of the amended statement of claim be struck out because they didn't establish an "ordinary reasonable viewer" would draw the alleged conclusions.

"We need to understand the judgment, take further legal advice and make a decision as to how to proceed going forward. We'll definitely proceed with the action but in which shape or form I'm unsure at this point," Mr Wagner said outside the Brisbane Supreme Court.
