Pasig City Mayor Vico Sotto said that the electoral protest filed by former Mayor Bobby Eusebio was just a nuisance case after he attended a hearing at the Commission on Elections (Comelec) on Thursday.

According to a report by Raffy Tima on GMA's 24 Oras, Eusebio filed the protest over the glitches encountered by vote-counting machines and defective SD cards during the midterm elections which allegedly led to the loss of the statements of votes.

Sotto, on the other hand, said that he was confident the case will soon be dismissed.

"Basta ang alam ko malinaw ang tinig ng mga Pasigeño. Alam naman nila 'yun, kahit 'yung nag-file ng kaso alam naman nila 'yun," Sotto said.

"Harassment na lang po ito pero we will respect the process, we will respect the decision of the Comelec. Confident naman po kami sa magiging resulta ng kaso," he added.

His legal counsel, Atty. Romy Macalintal, claimed that even if all the votes processed by the defective VCM will be deducted from the total votes garnered by Sotto, the latter would still be declared as the city mayor because he won by 86,000 votes over Eusebio.

"Very very clear na walang basehan dahil sa ang kinukwestyon lamang nila 'yung 81 vote-counting machines sa 81 clustered precincts and it only involves about 50,000 voters," Macalintal said.

Eusebio did not attend the hearing but was represented by Atty. Paolo Mabazza.

Mabazza also said that his client lost in the May 2019 elections because of vote-buying activities that took place in Pasig before the poll.

The Comelec has given 10 days to both camps to file their respective memorandum that will support their arguments.

From that point, the poll body will decide whether to dismiss the electoral protest or let it proceed. —Dona Magsino/LDF, GMA News
