The boy's family posted the video on social media and said their son was suspended over the incident.

It is now believed they are taking legal action.

The incident happened on Valentine's Day at Western Guilford Middle School in Greensboro, North Carolina.

And according to WYFF 4 News, school officials have identified the teacher as 49-year-old Paul Stennant.

They said: "This kind of behaviour toward a student is disturbing and unacceptable.

"We reported the behaviour to law enforcement and will no longer employ this person as a substitute teacher or in any other GCS position."

It is believed the teacher started working for the school in December and that local police have also launched an investigation into the incident.

The five-second video shows the student on the teachers back before the teacher flings him over his shoulder onto the ground.

It looks as if he pins him there before the footage ends.

Other students look on as the horror unfolds with one boy seemingly trying to push the teacher away from his friend.

For this fact my son was suspended for 7 days. Please I'm asking for justice."

Commenting on the video, Reyes Lopez asked what happened and what the reason was for the confrontation.

Mayo Corrales replied: "Nothing, a girl gave him chocolates and the teacher threw them in the sink and when the kid stood up the teacher punched him in the chest and after the class he went over to get the chocolates the teacher then took him and did this to him."
