Brian Molefe is no longer the head of Eskom.
It ruled that Molefe can't keep his R30-million pension payout.
In January, a court ruled Molefe’s reappointment as the power utility's CEO was unlawful.
The court unanimously found that Molefe resigned, his declaration that he did not resign was not true and that he was never entitled to pension money.
The court also ordered him to pay back R11-million he received as part of his pension pay-out.
But Molefe has refused to accept the judgement and is fighting to have it reversed.
In court papers, Molefe says the court made a mistake when it set aside an Eskom board decision to accept his early retirement.
