Madrid's initial appeal against Copa del Rey expulsion turned down

The Tribunal Administrativo del Deporte (TAD), Spain's Sports Arbitration Court, has rejected Real Madrid's appeal after their elimination from the Copa del Rey for fielding the suspended Denis Cheryshev against Cádiz in the Round of Thirty-two. The Blancos thus remain eliminated from the competition while Cádiz are qualified for the Round of Sixteen.

A week ago, the Spanish Football Federation's Competition Committee judge found in favour of Cádiz and against Real Madrid. This Thursday, the Appeals Committee ratified the sanction.

This ruling is not, however, definitive. The TAD has turned down Real Madrid's appeal arguing that they did not have the necessary paperwork to lift the suspension temporarily, but adding that they may meet again before the date on which the return game is scheduled to take place, and finally lift the disqualification ruling temporarily, thus allowing the game to take place.

"As of today, Friday December 11th, the TAD does not have at its disposition all of the documents that make up the case file and, as a consequence of that, is in no position to make an in-depth judgement. The Court, having studied the the arguments of the appealing party and the documents submitted to the Federation, has agreed not to award the requested precautionary measure asked for by the club given that the requirements demanded by the legislation in force are not met, although the above shall not under any circumstances be considered an in-depth judgement on the right to appeal", said the TAD in their statement.

The Court sent the resolution to both parties on Friday and gave them both a period of ten days to present any new evidence. Real Madrid have also been given the opportunity to modify their initial appeal.
