Malcolm Turnbull urges Liberal Party to refer Dutton to High Court
Malcolm Turnbull has confirmed that since being deposed of as prime minister, he has urged Scott Morrison and other colleagues to refer Peter Dutton to the High Court over his eligibility to sit in parliament.
Section 44 of the constitution says that “any person who has a direct or indirect pecuniary interest in any agreement with the Public Service of the Commonwealth” is disqualified.

“The point I have made to Scott Morrison and other colleagues is that given the uncertainty around Peter Dutton’s eligibility, acknowledged by the Solicitor General, he should be referred to the High Court, as Barnaby was, to clarify the matter,” Mr Turnbull tweeted from New York, where is currently staying following his resignation from parliament.
