Kidnapped Bay Area baby is located, suspects now in custody

LATEST April 28, 1:15 p.m. The San Jose Police Department said Thursday it would release one of the three suspects from custody. The released suspect won't face any charges, police said. See the latest story on SFGATE.

April 26, 9:45 a.m. Baby Brandon was located and is being taken to a local hospital for evaluation, the San Jose Police Department said late Tuesday morning. 

Three suspects are in custody, police said. 

Police said they will release more details on the suspects in custody and charges. 

April 26, 9:15 a.m. San Jose police said at a Tuesday morning press conference that they are talking to a person of interest in the alleged kidnapping of a 3-month-old baby.

Sgt. Christian Camarillo said the man who was shown on surveillance video taking Brandon Cuellar brought his own baby carrier to the apartment and this was a premeditated act. 

The boy was allegedly taken from his home while his grandmother was unloading groceries from a car outside, and Camarillo said the grandmother has provided  "inconsistent" statements to police. Camarillo said she is someone they are "really focused on."

"She knows more than she's telling us," Camarillo said.

April 26, 5:57 a.m. A 3-month-old baby was kidnapped on Monday from a San Jose apartment by a stranger while his grandmother unloaded groceries from the car, officials said.

The man walked into an apartment in the 1000 block of Elm Street in San Jose just before 1 p.m. and left with the child, Brandon Cuellar, the San Jose Police Department said on Twitter.

Police released surveillance footage of the man walking down the sidewalk holding a baby carrier covered by a white blanket.

"The family does not recognize this suspect," police said on Twitter. 

The California Highway Patrol released a photo early Tuesday morning on Twitter of the car the suspect may have been driving and then later deleted it.

“At this time we do not have a vehicle description or license plate," San Jose police told ABC 7 Tuesday morning after the photo was pulled. "When we have that info an Amber alert will be activated.”

The grandmother reported the abduction. She said Brandon was taken after she returned home from the supermarket and she brought him inside while she unloaded the groceries, San Jose Police Sgt. Christian Camarillo told NBC Bay Area. The child's mother was at work at the time and the father is incarcerated.

“In that short amount of time, someone entered the apartment ... and left with the baby,” Camarillo said.

Police described the alleged suspect as a short-haired Hispanic man and in the security footage he was wearing a gray hat, black mask, dark blue shirt and black pants. Brandon was last seen wearing a white long-sleeved onesie with dinosaurs at the time of the alleged kidnapping, police said. 

Police said to call 911 if you've seen Cuellar or the alleged suspect.

San Jose Police, CHP and the FBI are working the incident.

"At this time Officers and agents with the FBI are going door to door in the area of Elm St and surrounding streets in an effort to locate witnesses or any other info related to this case," San Jose Police said on Twitter. "We will continue updating this event until Brandon is found. All available resources are assisting with this investigation."
