Pet birds: Man loses custody dispute over parrot, macaw in York County

A man has lost a lawsuit that he filed against Ruffled Feathers Parrot Rescue and Sanctuary in the North Hanover Mall to regain custody of two exotic birds that he believed he had not permanently given up.

Max Cohn, of Owings Mills, Maryland, argued in the lawsuit in the York County Court of Common Pleas that he “relinquished the birds” — an African grey parrot named Chico and a blue-and-gold macaw named Pedro — “under circumstances that left him with the impression that he could have the birds returned to him if he asked.” An Amazon parrot named Roberto died.

But in a seven-page opinion dated Aug. 28, Common Pleas Judge Andrea Marceca Strong wrote that Cohn failed to prove that the paperwork he’d signed giving up the birds was ambiguous.

A reasonable person, she said, “would have — and should have — refused to sign a document that so clearly and completely relinquishes all rights to the birds if that was not his intent.”

“We’re very happy with the decision,” said Roberto Ugarte, Ruffled Feathers Parrot Rescue and Sanctuary’s attorney.  “I didn’t think they had a strong argument, and I’m glad that the judge saw it the same way that we did.”

Bernard Ilkhanoff, Cohn’s attorney, could not be reached on Monday.

The lawsuit cannot be refiled.
